General Terms and Conditions of Use for the Prerivid Platform and User Information

The Fundación Empresa Universidad Gallega – hereinafter FEUGA, with NIF G 15051667, located at Rúa Lope Gómez de Marzoa s/n, 15705 Santiago, email feuga@feuga.es, and registered in the Foundation Registry of the Xunta de Galicia under number 155, makes the PLATFORM www.prerivid.es (hereinafter PLATFORM) available to Internet users free of charge. Access to and/or use of the PLATFORM is completely voluntary and grants the person using it the status of USER. Every USER accepts, from the moment of access, without any reservation, the content of these “General Terms and Conditions” as well as, if applicable, the “Specific Terms” that may complement, replace, or modify them in any way in relation to the services and content of the PLATFORM. Therefore, the USER should carefully read both the General and Specific Terms before accessing or using any service of the PLATFORM, under their sole responsibility. In any case, FEUGA reserves the right, at any time and without prior notice, to deny access to this site to any users who fail to comply with these general conditions or the specific ones that apply to them. We also inform you that we comply with the obligation of having at least one of the domains we own registered in the corresponding registry.

Object and Modification of Terms

FEUGA provides USERS with the ability to navigate and access the content and services of the PLATFORM, provided they do so in accordance with the provisions of these GENERAL TERMS AND CONDITIONS.

In any case, FEUGA reserves the right, at any time and without prior notice, to modify or remove the content, structure, design, services, and access and/or use conditions of this site, whenever it deems appropriate.

User Responsibility

The USER agrees to use the services and content provided by the PLATFORM in accordance with current legislation, the principles of good faith and generally accepted practices, and not to act in any way through the Website that would contravene public order. Therefore, any use for illicit purposes or any action that may harm, hinder, damage, and/or overload the normal functioning and use of the PLATFORM, or directly or indirectly harm it or any third party, is prohibited.

The PLATFORM user will not transmit anything through the service that may violate the values and dignity of individuals, in accordance with national and international human rights protection standards.

The PLATFORM user agrees to provide truthful and accurate information about themselves in the registration form.

Additionally, the reproduction, distribution, transmission, adaptation, or modification of the content of the PLATFORM website (texts, designs, graphics, information, databases, sound/image files, logos, etc.) by any means and in any form is prohibited, unless authorized by its legitimate owners or permitted by law.

Any commercial or advertising use of the aforementioned content, other than what is strictly allowed, is also prohibited, as well as any general violation of the rights derived from them.

The USER will be solely responsible for the use of this site and for complying with these General Terms and Conditions in their entirety. Consequently, the USER agrees to keep confidential and reserved their access credentials, passwords, or similar data assigned to access the PLATFORM or any of its services, and will be responsible for any damages arising from misuse by themselves or third parties, both against the user (considered as a result of their negligence) and for any damage that FEUGA may suffer due to the breach of these General Terms and Conditions.

Any breach of these General Terms and Conditions may result in civil or criminal legal proceedings against the user.

User Registration

FEUGA reserves certain services offered through the PLATFORM for registered USERS, who must complete the forms accessible through the Website. However, FEUGA also makes available to users certain services that require additional registration by the USERS.

FEUGA will process personal data automatically for the purposes and under the conditions defined in its Privacy Policy, which is outlined in this Legal Notice.

Disclaimer of Warranties and Liability

FEUGA does not guarantee or accept responsibility, under any circumstances, for the following events and content, nor for any damages or losses that may arise from them: Lack of availability, continuity, access, maintenance, and effective functioning of the website and/or its services, as well as the updating, accuracy, completeness, relevance, timeliness, and reliability of its content, regardless of the cause, and any technical or other problems that may arise from these events. The transmission and/or presence of viruses, harmful elements, or programs that could damage users’ equipment as a result of accessing, using, or browsing the site, or cause alterations to their electronic documents or files. The unlawful, negligent, fraudulent use, identity theft of a third party, or use contrary to these general conditions, good faith, generally accepted practices, or public order, of the website, its services, and content by USERS. Faults or defects in the content and/or services accessed through the PLATFORM. The receipt, storage, obtaining, dissemination, or transmission by USERS of content from the PLATFORM. Unauthorized third parties gaining knowledge or using any information related to the characteristics and circumstances of the USERS’ use of the PLATFORM’s content and services. The non-compliance of third parties with their obligations derived from or contracted in relation to services provided to USERS through the PLATFORM, as well as the lack of quality, reliability, suitability, legality, usefulness, and availability of services provided by third parties and made available to USERS on this site. The above list is merely indicative and in no case exclusive or exhaustive in any of its points. In all cases, FEUGA EXCLUDES ANY LIABILITY FOR DAMAGES OF ANY NATURE, WHETHER DIRECT OR INDIRECT, ARISING FROM THESE EVENTS AND ANY OTHER SIMILAR EVENTS NOT SPECIFIED HERE.

Intellectual and Industrial Property Rights

The texts, designs, images, databases, logos, structure, trademarks, and other elements of this site are protected by intellectual and industrial property laws and international treaties. Any reproduction, transmission, adaptation, translation, modification, public communication, or any other exploitation of all or part of the content of this site, carried out in any form or by any means, electronic, mechanical, or otherwise, is strictly prohibited unless prior written authorization is obtained from FEUGA. Any infringement of these rights may result in extrajudicial or judicial civil or criminal proceedings.

FEUGA does not grant any license or authorization of any kind regarding its intellectual and industrial property rights or any other property or right related to the PLATFORM, its services, or its content.

In order to preserve possible intellectual property rights, if any USER or third party believes that their legitimate rights have been violated by the inclusion of certain content on the Website, they must notify this circumstance in writing to: FEUGA, Rua Lope Gómez de Marzoa s/n (Campus Universitario Sur) 15705 Santiago de Compostela.

Applicable Legislation and Jurisdiction

These General Terms and Conditions shall be governed by Spanish law.

For any matters that may arise or actions that may be taken resulting from the provision of the PLATFORM’s services and content, and regarding the interpretation, application, compliance, or non-compliance with the provisions set forth herein, FEUGA and the USER, expressly waiving any other jurisdiction that may apply, agree to submit to the jurisdiction of the Courts and Tribunals of Santiago de Compostela.
